The purchase and sale of Real Estate


LA COMPRAVENTA

The real estate sale and purchase process consists of three steps:

1.    THE RESERVATION

2.    EARNEST MONEY CONTRACT

3.    PUBLIC DEED OF SALE

Did you find the house of your dreams with SALVADÓ & KILCHHERR? Well, with the RESERVE you can stop marketing it and give the owner a period of time to analyse the economic offer presented. Our agency becomes the depository of this amount, giving the buyer the right to transfer it to the owner in order to formalise the penitential deposit contract, if accepted.

The PENITENTIAL DEPOSIT CONTRACT is a contract signed by the buyer and the seller that establishes the terms under which the deed of sale will be drawn up. It is usual to give 10% of the purchase price as a penitential deposit and to establish a period of up to 90 days for the signing of the deed before a notary. 

The DEED OF PURCHASE AND SALE is a document that is registered in the Land Registry, thus proving the existence of the property at a legal level, ratifying that the property is free of occupants and encumbrances, and showing the will of both parties to comply with the contract. The notary is chosen by the buyer and in the event that one of the parties does not understand Spanish, he/she must be accompanied by an official sworn translator, at the expense of the party who needs it.

INFORMATION FOR THE OWNER: THE SALE OF A PROPERTY.

In the event of SALE AND PURCHASE and at the time of signing, the seller must bring:

·  Original deed of sale.

·  Original DNI of the owners.

·  Valid Certificate of Habitability.

·  Valid Energy Certificate.

·  Last IBI receipt (paid).

·  Certificate from the community administrator stating that the property/s is/are up to date with the payment of the community fees and that the budgeted and approved payments have been paid in full.

·  ITE (Technical Building Inspection) for buildings over 50 years old.

·  The latest utility bills in order to proceed with the change of ownership.

·  The keys to the property.

In order to market your property for RENT, we will need a copy of the following documentation:

·  Authorisation / Exclusive brokerage signed by the property.

·  Title deed.

·  Plan of the property (if available)

·   Habitability Certificate in force (if you do not have it, our agency can process it).

·  Energy Certificate in force (If you don't have it, we can arrange it).
